New rules in effect for divorces in New York State

When New York's Divorce Reform Act of 2010 went into effect on October 12, it finally ended our state's holdout as the last to approve no-fault divorce.  A divorce can now be granted if the relationship between husband and wife has been irretrievably broken for at least six months—as sworn to by either of the spouses.  The new rules make it much easier to obtain a divorce, but there are still many situations to address and financial and logistical issues that have to be worked out, which may include—

  • Child custody
  • Child support
  • Division of debt
  • Domestic violence
  • Enforcement
  • Estate planning
  • Payment of expert and counsel fees
  • Parental relocation
  • Pension funds
  • Post-divorce modifications
  • Property division
  • Qualified domestic relation orders
  • Shared parenting
  • Spousal support
  • Visitation arrangements

There are also personal and emotional implications for everyone involved.  At Hall, Ricketts, Marky & Gurbacki, experienced divorce attorney Jay Ricketts takes some of the pressure off by guiding our clients through the process.  The goal is to get lives back in order as quickly and effectively as possible.

Full disclosure and informed decisions at a difficult time

Together with the new law, the Child Support Standards Act has established a new formula for determining temporary maintenance that could lead to a final award of maintenance.  Hall, Ricketts, Marky & Gurbacki proceeds on the basis that the only way to negotiate these financial issues successfully is to provide and secure full financial disclosure as soon after the beginning of the case as possible.  When you are in an unhappy marriage, you need competent, sound and dispassionate legal advice to make the right decisions.

Getting help is simple

There is no need to fear the mystery and rumor that surround matrimonial proceedings in the minds of many.  If you are considering a marital separation or divorce, contact us to schedule an informative appointment with Jay Ricketts.  In little more than an hour, you can get the specific information to guide you in the direction best suited to your particular situation and needs.  You are welcome to bring a friend to this initial consultation, to help you consider your options or just to serve as a calming influence.
