So you want to apply for a liquor license, eh? If you live in New York, there are many things you have to have in order and a number of things you will want to keep in mind throughout the process. Here’s a quick overview of the process, along with a few notes to keep in mind.
5 steps to Follow
First, check the minimum eligibility requirements to make sure that you are able to be approved for a NY liquor license. These include regulations such as you must be 21 years of age (or older), you cannot be a convicted felon and that you are a US citizen or permanent resident.
Second, identify which license you are seeking. There are differing licenses for different applications, such as retail environments like a grocery store or a pub/bar/tavern.
Third, determine if there are any restrictions on your location that would keep you from obtaining a license. As a general rule, applicants cannot be within 200 feet of a church, school or synagogue. There are a few exceptions, but you would want to consult an attorney to identify them.
Fourth, you must notify your local government as to your intent to apply for a liquor license. This must be done 30 days before applying with the State Liquor Authority.
Fifth, complete all portions of the license application. Note: there is a lengthy list of items to include with your application, including photos of the interior and exterior of your establishment, lease agreements, proof of citizenship, Federal tax ID number and many other related items.
Sixth, consider working with an attorney to file your application. In 2009, the NY State Liquor Authority created a new option that allows attorneys to self-certify applications that they file for their clients. This Self-Certification Program allows for a much quicker review process, based on the assumption that the attorney filing the application has taken the proper steps in doing so. This allows applications to be approved in a time frames as quick as one month, as opposed to six to twelve months.
